Please read these Terms of Service ("Terms") carefully before using the Ishara mobile application (the "App"), operated by Shiloh Software LLC ("we," "us," "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to use the App. By using the App, you represent that you meet this requirement.
Ishara is a personal health and fitness tracking application that aggregates data from sources such as Apple HealthKit, Oura Ring, and manually logged nutrition and workout information, and provides analytics, summaries, and AI-generated coaching, insights, and feedback based on that data.
The App does not provide medical advice, diagnosis, or treatment. All content, insights, scores, summaries, and coaching messages — including any AI-generated content — are provided for informational and motivational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment from a qualified physician or other healthcare provider.
You should never disregard professional medical advice, or delay seeking it, because of something you read or were told within the App. Always consult a physician or other qualified health provider with any questions you may have about a medical condition, medication, exercise program, or dietary change, especially before making any decision based on information from the App.
Consult your healthcare provider before making any decisions related to medications or supplements, including GLP-1 medications. Any symptoms of concern should prompt you to seek medical attention from a qualified clinician, regardless of what the App's data shows.
If you believe you are experiencing a medical emergency, call 911 (or your local emergency number) immediately. Do not rely on the App in an emergency.
Some content within the App — including coaching messages, summaries, report cards, and insights — is generated by artificial intelligence systems based on your logged data. AI-generated content:
You are solely responsible for evaluating the accuracy and appropriateness of any AI-generated content before acting on it.
You understand that engaging in any exercise, dietary change, or health-related activity carries inherent risk. By using the App, you voluntarily assume full responsibility for any risks associated with your use of the App and any actions you take based on information provided by the App, including AI-generated content.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use of your account.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and store your health and personal data. By using the App, you consent to the data practices described there.
Certain features of the App require a paid subscription, billed and managed through Apple's App Store in accordance with Apple's standard subscription terms, including auto-renewal unless cancelled. Pricing, trial periods, and billing terms are presented at the point of purchase within the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY HEALTH DATA, SCORES, OR AI-GENERATED CONTENT WILL BE ACCURATE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHILOH SOFTWARE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING ANY RELIANCE ON AI-GENERATED CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Shiloh Software LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
We may suspend or terminate your access to the App at any time, with or without cause. You may stop using the App and delete your account at any time.
We may update these Terms from time to time. If we make material changes, we will notify you within the App and require you to accept the updated Terms before continuing to use it.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles.
